Terms of Service

This agreement applies to services provided by Xirsys, LLC, located at 25350 Magic Mountain Parkway, Suite 300, Santa Clarita, CA 91355. By registering for or using the services, the client agrees to these terms.
1. Services and role
Xirsys operates globally distributed WebRTC STUN/TURN infrastructure and APIs that help real-time applications establish and maintain connections. Xirsys relays encrypted WebRTC traffic as a transient conduit and does not store communications content. Account-level metrics may be maintained for billing, operations, security, and service improvement.
2. Eligibility and accounts
Clients must provide accurate account, contact, and billing information and must be authorized to bind any organization they represent. Clients are responsible for credentials and activity under their accounts.
3. Lawful use and acceptable use
Clients must use Xirsys only in compliance with applicable law. Prohibited use includes malicious code, unauthorized access, infringement, unlawful content, sanctions violations, traffic floods, network probing, service abuse, or activity that harms Xirsys infrastructure or other customers.
4. Fees and billing
Paid plan fees are listed on the Xirsys website and are payable in U.S. dollars. Recurring charges are billed according to the selected plan. Prices may change with posted notice. Xirsys may suspend or terminate service for unpaid balances, failed payments, or unresolved billing issues.
5. Upgrades, downgrades, cancellation, and overage
Clients may upgrade, downgrade, or cancel through the dashboard. Plan changes may affect billing, credits, or refunds according to the billing cycle and plan type. Accounts that exceed included monthly TURN bandwidth may incur overage fees at the rate for the selected plan, and clients may upgrade to better match usage.
6. Uptime and maintenance
Paid production accounts target 99.95% monthly uptime. Planned maintenance, client-side issues, third-party failures outside Xirsys control, and force majeure events are excluded. Validated availability claims may be eligible for service credits as the exclusive remedy for covered unavailability.
7. Data protection and privacy
Xirsys processes client account, billing, and support data as described in the Privacy Policy, Data Processing Agreement, and related data-processing documents. Service traffic is relayed as encrypted transient traffic and is not stored as communications content by Xirsys.
8. Sub-processors
Xirsys may use sub-processors for hosting, support, payments, analytics, and related operations. Xirsys remains responsible for its sub-processors according to applicable data-processing commitments. The current provider list is available on the Sub-processors page.
9. Intellectual property
Xirsys retains all rights in its services, software, systems, documentation, marks, and infrastructure. Clients retain rights in their applications, content, and customer experiences. Neither party receives rights to the other party's marks unless agreed in writing.
10. Confidentiality and security
Each party must protect the other's confidential information with reasonable care. Clients may not reverse engineer, decompile, or attempt to derive internal configurations or trade secrets of the Xirsys services.
11. Warranties and disclaimers
The services are provided without warranties except as expressly stated in the agreement. Xirsys disclaims implied warranties such as merchantability, fitness for a particular purpose, and responsibility for client-side errors, client applications, or information obtained through use of the services.
12. Limitation of liability
Xirsys liability is limited to amounts paid for services during the period specified by the agreement. Xirsys is not liable for indirect, incidental, consequential, special, punitive, lost profit, lost data, business interruption, or similar damages to the maximum extent permitted by law.
13. Force majeure
Xirsys is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, civil disturbances, terrorism, utilities or telecommunications failures, governmental action, malware, third-party supplier failures, or incompatible client equipment or software.
14. Export and sanctions
Clients must comply with applicable export control and sanctions laws. Xirsys may suspend service where needed to comply with such laws.
15. Governing law and disputes
Disputes are governed by California law, with venue in Los Angeles County, California, unless otherwise required. Clients should first contact support@xirsys.com to attempt resolution before formal proceedings.
16. Term and termination
The agreement begins when a client registers and continues until the account is canceled or terminated. Xirsys may suspend or terminate accounts for breach, non-payment, legal compliance, fraud, or network harm. Certain obligations survive termination.
17. Notices and changes
Legal notices may be sent to Xirsys, LLC, 25350 Magic Mountain Parkway, Suite 300, Santa Clarita, CA 91355, or legal@xirsys.com. Xirsys may update these terms by posting revised terms on its website. Continued use after the effective date indicates acceptance.
